Hong Kong court hears transsexual wedding case

 

A woman who was born a man has taken her fight to marry her boyfriend to Hong Kong's top court.

The woman, identified only as W, underwent gender change surgery at a public hospital a few years ago.

Her lawyer argues that she is listed as female on her passport and identity card, and considered a woman in every other aspect of her life.

Hong Kong's marriage registry has refused her request because her birth certificate still classes her as male.

The government has argued that she cannot get married as it would constitute a same-sex marriage, which is not legal in Hong Kong.

"The laws of marriage can and should recognise that sexual identity can change," W's lawyer David Pannick said.

He added that the issue of same-sex marriage was not relevant to this case, and that W's gender change surgery had been considered medically necessary, and been performed in a public hospital using government funds.

This is a very interesting case, but i feel that she has a right to be married...

I agree this is very interesting but i think she should be allowed to get married because her license states that she is female.

I hope she's allowed, at least. The tides are changing with matters like these; fingers crossed that it influences Hong Kong in time to allow these two to marry.

I think the question up top is a little mysterious because I think that the courts will not allow her to be married, even though I believe she should have that right.

I think since she had a change done to her body, *Not that I'm against same sex marriage but for argument sake* she now has all the part of being a women i think that she should have the right to marry a man because if she mentally believes she is now i women that let her, but ultimately its up to the courts to chose.
