The Nook: Film-makers Arrested over Fake Firearms

At 10:40pm a man was walking through a park in Australia and saw a menacing man holding a gun to another man's head. So he ran to the police and they surrounded the park and arrested four men. They also seized some film equipment and a fake gun. Apparently they were making a film and didn't tell anyone. They are being charged with being a public nuisance and possesing a firearm. In Australia imitation guns are viewed as real guns.

Is it fair to charge someone with possesing a firearm when it's just an imitation?
Are people over sensitive and afraid of firearms?

I understand their concern, this guy thought he was saving someone's life. Filming at night and not telling anyone isn't really smart. But I don't think they should be charged, but dumb on their part.

Being somewhat knowledged with film making myself, the film makers should have been punished because they did not get a permit to film in that location in the first place. That is if it was a public area, which it sounds like it is if another observed.

Although it was indeed a fake gun, they should still get punished for the lack of a permit and also for gun possession, even if it was fake. They were idiots for not letting people know or getting a permit. FOOLS!

Well drew, we always film on public property without getting permission first. what a hassle. They were just in a park? a good idea would to be placing signs up that say "production in progress"
As for the guns. I think its kinda ridiculous to charge someone with possession of a firearm when its FAKE. that doesn't make sense to me. But the fear factor towards firearms is relevant. Guns are very dangerous.

I think the police did a right thing arresting them. who knew the guns were fake? nobody.
people aren't oversensitive, if I saw somebody with a gun in the park I would have done the same thing that guy did.

I believe it's fair to charge these knuckleheads with a firearm possession because you can't mess around with guns like this. Especially when these guys a portraying an incident where a guy is seemingly about to get his head blown to bits. In general I think there are a lot of people oversensitive to guns, as far as are they oversensitive because they don't want gun look-alikes on the street, no.

It definitely was not too brilliant of these guys not to let anyone know what they were up to for the reason that someone might come along and think it is a real gun, which is exactly what happened. For that they should be charged with being a public nuisance. However I don't believe they should be charged with possession of a firearm. In some cases were the gun is being treated as a real gun by both the victim and the offender, like if a fake gun is used in a robbery, then they should be charged with possession. In this case ever one knew the gun was a fake. well, ever one except for the late night park walker.

i see why the guy freaked out and went to the cops. anyone sane would have done the same thing its common sense. maybe they should just use these guys as an example and give them a warning reminding people of their laws

yeah maybe just a fine or community service, but yeah i think it would have been smart for them to put up a notice saying they were filming.

i think it would have been smart for the film makers to have maybe put up some warnings and presented a permit

and as far as the gun thing goes
i dont think a permit for a fake firearm is necessary
i was actually under the impression that all fake firearms are marked with an orange frame for example

however real guns
yes
permit required

I think it's fair, maybe next time they will notify people that they are making a movie

They should be charged for filming without a permit. But it's rediculous to be charged with possesing a firearm when it's nothing more than a toy.
