The Nook-Judge rules that privacy rights extend to drugs in luggage


The Newfoundland Supreme Court ruled that socks, undies, toothbrush, wads of cash and illegal drugs are considered private when checking luggage for a flight.

A man was arrested in 2006 when authorities discovered 14 grams of cocaine, 62 ecstasy pills and $11,000 in his suitcase aftr he had checked it for the flight in 2006. The man' lawyer said it is a violation of his client's charter rights against unlawful search and seizure.

The court said it is the job of authorities to proctect passengers from weapons and explosives, not to find illegal drug users.

"Obviously, searching or screening the accused's bags for the presence of drugs does not fit into the category of purposes for which screening was authorized,"

NO!!!

it was right for that man to be arrested if he had drugs in his suitcase. sure, screening machines weren't built to catch people with illegal drugs, but if it does i don't see the problem in it. when you're going on a plane you know your bags are going to be searched, so don't bring your illegal drugs with you on the plane, or at least find a better place to hide them than in you suitcase.

This guy shouldn't be let off the hook. He needs to be arrested for drug trafficing.

yes he should be let off the hook, 14 grams of cocaine? and only 62 pills of ecstacy.. honestly thats not enough for like a drug lord or anything. As if he he had like 20 suitcases filled with coke. And like the guys lawyer said its the screening things job to find things like bombs not someone with a drug problem.

well i don't think he should be let off the hook, maybe a smaller charge for possession, but if you're that dumb that the security was able to find the drugs then apparently he is a newb trafficer anyways.

i thought it was illegal to have drugs on you at the airport? but i understand the argument and i dont think they should particularly be able to search for drugs but if they stumble upon them then that sucks, its illegal. but i dont think he should be in trouble because they already checked the bag through and everything, he wasnt with the bag at the time. idk its confusing like if you got caught with coke at the security checkpoint then you should be in trouble.

if you have ILLEGAL drugs, isnt that breaking the law, and i dunno how their system works for sure, but if that were here it would be like having the right to search for something, and if you find other illegalities than those could,too,be taken.

if illegal drugs were part of your private things, then that is rediclous...
i don't think the man should be "off the hoook" because he was trafficking drugs.
